HALF-FULL REPORT 04/09/10

Let’s start the HFR this week by my asking you to stop reading it.  What I suggest you do right now, this very moment is to pick up the phone and call the local offices of both US Senators in your state.

Ask to speak to the staffer who handles foreign policy/national security issues for the Senator.  Tell him or her that as a voting constituent, you respectfully request that the Senator vote NO on Senate Ratification on the nuclear arms control treaty – mislabeled "START II" as that was a treaty back in January 1993 – with Russia signed by Mr. Obama in Prague on April 8th.

Explain that you consider this treaty to be dangerous to America in the extreme, as it requires the US to freeze its nuclear weapons technology, but not Russia.  This is, as critics are putting it, an open invitation to Russia to modernize its way to nuclear dominance.

Do not get into a discussion with the staffer and avoid a debate with him.  Make it quick and polite.  Simply state your request, the reason for your request, and conclude with saying that how the Senator votes on this critical issue of US national security will determine how you vote when he or she is up for re-election.

OK – make the calls (that’s plural for you have two Senators) and I’ll wait ‘till you get back….

…Thanks.  Those calls you just made are important, for no treaty signed or agreed to by a president can become law unless it is ratified by the Senate.  Article II, Section 2, Clause 2 of the Constitution requires a supermajority of two-thirds of the Senate to approve the ratification of a treaty.  That’s 67 votes.

There’re 59 Dems.  Even if Lost Harry Reid can get every single one of them to ratify – very doubtful as so many of them are running scared this November – he still needs 8 Pubs to betray their party and country, and there just aren’t that many RINOs among the Pubs’ 41 seats.

With the Dems’ passage of ObamaCare, we need a win now and Zero needs a comeuppance.  Here’s where it can happen.  Here’s where you can take a stand for our country’s security.  Thanks for making those calls.

A teachable moment opportunity appeared this week with Mr. Zero recess-appointing Marxist looney Craig Becker to the National Labor Relations Board (NLRB).  As Investor’s Business Daily explains, the NLRB may now "rush through pro-union rulings," such as Card Check, which the Dems failed to pass in Congress under the Orwellian name of Employee Free Choice Act (EFCA).

The IBD article quotes the hyper-left Nation magazine as saying:  "There is reason to believe that much of what organized labor hopes to accomplish via EFCA will be realized through the rule-making power of the NLRB."

And there’s the opportunity – to ask:  Where does the NLRB get this "rule-making power" constitutionally? 

The structure of our government is based on the "separation of powers" between three separate governmental branches:  legislative (Congress which passes laws), executive (the President and his agencies which execute the laws Congress passes), and judicial (the courts which adjudicates disputes and alleged violations of the laws).

This means that Executive Branch agencies – to which the NLRB belongs – have only the constitutional authority to execute laws, not to make them.  Back in the 1930s, however, FDR pressured Congress to "delegate" its legislative authority to the executive branch so he could impose his National Industrial Recovery Act to unconstitutionally regulate business.

Then the craziest thing happened.  Congress didn’t object, but the Supreme Court did, striking down NIRA delegations of power in two 1935 decisions known as Schechter and Panama Refining.  FDR threatened to "pack the court" with additional justices so the supremes never disobeyed him again – yet these decisions were never reversed.

What happened instead is that Congress never articulated a standard or gave explicit permission for executive law-making, and the courts have simply acquiesced to the ever-expanding assumption of federal agencies’ delegated authority to make and enforce their own laws.

In other words, the "rule-making power" of the NLRB, and all executive branch agencies like the FDA and the EPA, is a fiction, an assumption of legality that has never been fully challenged in the Supreme Court.  It’s about time it is.

Back in 1997, the Cato Foundation wrote an excellent treatise on the delegation issue, concluding:

"Forcing Congress to vote on each and every administrative regulation that establishes a rule of private conduct would prove the most revolutionary change in government since the Civil War — not because the idea is particularly radical, but because we are today a nation governed, not by elected officials, but by unelected bureaucrats."

Part of what we must demand of the new Republican Congress next year is the end of delegation.  All that is really required is the formal acknowledgement that Congress never legally authorized delegation in the first place.  Thus all the "rule-making power" of all federal agencies would be terminated.

"No regulation without representation!’"  It makes a great battle cry for TeaPartyers.

In the as-if-we-needed-more-evidence department, Mr. Zero performed an anti-American hat trick this week, triply-proving that he has no intention of defending America.

On top of signing a treaty with Russia that prevents us from any modernization or improvements of our nuclear deterrent, on top of announcing that we will not use that deterrent against an opponent who attacks us with biochem weapons, he has now removed any terms from the US National Security Strategy that Moslem terrorists might find offensive, such as "Jihad" and "Islamic extremism."

Jack Kelly hit the nail bang on the head with his observation that The Greatest National Security Threat to America Is In The White House.  How unconstitutional a president could there be than one who refuses to defend the nation he took an oath to protect?

We hear increasing calls for his impeachment (although "impeachment" means a trial by the House – removal from office requires a vote to convict by the Senate, which is why Clinton remained president even though impeached as the Senate failed to convict).  This is a non-starter as it would lethally distract the new Republican majority from repairing Zero’s damage.

Thus the argument regarding his ineligibility is becoming more persuasive to more people by the day.  An inspiring example is Lt. Col. Terrence Lakin, MD, who asks that his Commander-in-Chief prove his eligibility, for without such proof, he has a "Duty to Disobey" orders that may be illegal.  (To help Terry Lakin, go here.)

It is absolutely astounding that the President of the United States refuses to provide his birth certificate or identify the hospital and attending physician. 

He has spent close to $2 million dollars on lawyers paid to prevent access to this most basic information, as well as his Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, nor his medical records, Illinois State Bar Association records, any baptism records or his adoption records.

You don’t have to be a "birther" to think it dangerously absurd for none of this to be known about the president – and even more absurd for him to ferociously prevent any of it from being known.

As the evidence mounts that this man is a clear and present danger to the nation he was elected to lead, the belief his presidency is illegitimate and illegal will spread far beyond those in the "birther movement" and into the general population. 

As the immensity of the danger of his continuing to occupy the White House dawns on them, more and more people will demand the one and only solution that will solve the problem:  they will demand his resignation from the presidency.

As the demand grows that he resign as did Richard Nixon, the demonization of his opponents as racists, as purveyors of hate and violence will grow.  We can expect one or more staged American Reichstags, perhaps even a staged and failed attempt on his life.  The last thing in the world any of us want is any physical harm to him – but that will not stop his fascist thugs from staging something to try and prove otherwise.

None of this should deter the demand:  this man is not fit to lead us, he means to do us harm;  he is not eligible to lead us, his presidency is illegitimate and illegal – therefore he must resign.  Resignation is the solution.  Expect more and more folks to clamor for it.

Besides bowling like a retard and throwing like a girl, "surely," a TTPer tells me, "something must be terribly wrong with a man who seems to be far more concerned with a Jew building a house in Israel than with a Moslem building a nuclear bomb in Iran."

Compare Zero, then, to someone who does know how and why America should be defended – Col. Allen West.  Here’s how he answers a question regarding what to say to liberals who want to apologize to Moslems for attacking us.  Note how the other panel members have not a fumbling clue about what to say:

 

Col. West is running for Congress in Florida’s 22nd district.  He’s been endorsed by Sarah Palin.  I’ve met him – he’s an extraordinary man.  He’ll be hell on wheels on Capitol Hill.  Then watch for a push for him to be on the 2012 ticket.  Palin-West?

While we were distracted by the danger of Zero, a nation committed suicide this week.  It was a big country, the size of Texas, with 50 million people, an ancient history, endowed with wonderful natural resources, that suffered horribly in its struggle to be free and found that it had not the will to survive.  The country is Ukraine.

Colonized by Imperial Russia in the 1700s, its independence crushed by the Bolsheviks and reincorporated into the Soviet Union in the 1920s, suffering genocide in a famine purposefully caused by Stalin that killed millions in the 1930s (called the Holodomor, the story of the Ukrainian Holocaust is told by Robert Conquest in The Harvest of Sorrow), finally achieving full independence for the first time in centuries with the breakup of the USSR – Ukraine had every possibility for a bright future.

But Russia wouldn’t let go.  The Kremlin subverted Ukraine’s leaders at every turn, and they subverted themselves with massive corruption and incompetence.  Earlier this year, Ukrainians chose to elect a Russian stooge as their president, Viktor Yanukovych.  This week, he surrendered Ukraine’s sovereignty to Russia.

At Moscow’s bidding, he dissolved the commission in charge of preparing Ukraine for membership in NATO.  What he really dissolved was Ukraine’s independence.  Ukraine is once again a Russian colony.

As historian Will Durant famously observed:  A great civilization is not conquered from without until it has destroyed itself from within.

Ukraine has destroyed itself from within.  We should take heed from its example.

There are so many other examples in the world and across America to take heed from – and there’s no more time now to discuss them.  The sun is over the yardarm and TGIF.  (The Brits, you know, say THITWA – Thank Heavens It’s The Weekend Again.)

We will have time to discuss them, and a lot more, at the San Diego Rendezvous.  We have an amazing array of speakers – from Congressman Dana Rohrabacher to famed author Nathaniel Branden to life extension guru Will Block to universal genius Skye D’Aureous (his IQ is 240) to legendary intelligence expert Alex Alexiev, plus Joel Wade, Jack Kelly, and yours truly.

We’re going fishing on a TTPer’s fishing boat, going to Sea World, basking in the California sun, creating Plan B strategies with my wife Rebel – and enjoying the irreplaceable camaraderie between fellow TTPers.

Let me ask you a serious question.  The next Rendezvous after San Diego will be in Washington the weekend following the election, November 5-7.  The next seven months are going to be the ugliest, roughest, toughest, most stressful period in modern American history. 

Do you really want to endure them without the soul-soothing, shot-in-the spiritual arm of a TTP Rendezvous?  Without the critically practical understanding of what’s going on in the world that you gain at a TTP Rendezvous?
